“Tonight, I say this to my Republican colleagues who are defending the indefensible: There will come a day when Donald Trump is gone, but your dishonor will remain.”

So Representative Liz Cheney (R-WY), vice chair of the House Select Committee to Investigate the January 6th Attack on the U.S. Capitol, damned her Republican colleagues at tonight's first hearing on the January 6 insurrection.

And that was only a piece of what we heard tonight.

Calmly, carefully, convincingly, and in plain, easy to understand language, committee leaders Bennie Thompson (D-MS) and Cheney placed former president Donald Trump at the center of an attempt to overturn our democracy. They were very clear that what happened on January 6 was an attempted coup, an “attempt to undermine the will of the people.” All Americans should remember, they reminded us, that on the morning of January 6, Donald Trump intended to remain president, despite his loss in the 2020 election and his constitutional obligation to step down in favor of President-elect Joseph R. Biden, as every president before him had done.

The committee established that there was no fraud in the 2020 election that would have changed the results of the election, showing testimony from Trump’s attorney general Bill Barr that the argument that Trump had won was “bullsh*t.” The committee presented testimony from other administration figures, including Trump’s chief of staff Mark Meadows and his daughter Ivanka, that Trump had been told repeatedly that he had lost. And yet, even with his inner circle telling him he had lost, and even with more than 60 failed lawsuits over the election, Trump continued to lie that he had been cheated of victory.

It was Trump who “summoned the mob, assembled the mob, and lit the flame” for January 6, the committee says. Unable to accept his loss and determined to remain in power, Trump organized and deployed an attack on our democracy.

The committee established that the attack on the Capitol was not a random, spontaneous uprising. The rioters came at Trump’s invitation. While they had been muttering about the results since immediately after the election, it was Trump’s tweet of December 19, 2020, that lit the fuse. That night, the former president met with lawyers Sidney Powell and Rudy Giuliani, former national security advisor Michael Flynn, and others at the White House. Shortly after the meeting, Trump tweeted that it was “tatistically impossible to have lost the 2020 election. Big protest in D.C. on January 6th. Be there, will be wild!”

Members of the extremist organizations the Proud Boys and the Oath Keepers took Trump’s December 19th tweet as a call to arms. On December 20, they began to organize to go to Washington. These radical white supremacists had taken great pride in Trump’s shout-out in a presidential debate on September 29 that the Proud Boys should “stand back and stand by.” After that comment, membership in the Proud Boys had tripled.

Members of the Proud Boys and the Oath Keepers testified that they went to Washington because Trump personally asked them to. “Trump has only asked me for two things,” one man testified: “my vote, and he asked me to come on January 6.”

Cannon said he also had a brief conversation with Pence in November about voter fraud claims, during which he told the vice president he was not finding evidence of widespread fraud to alter the results of the election.

Derek Lyons, who served as White House staff secretary, also told the committee that allegations of fraud were discussed in a meeting more than a month after the election, during which White House counsel Pat Cipollone and Herschmann told Trump none of his claims had been "substantiated to the point where they could be the basis for any litigation challenge to the election." 

"President Trump's own vice president and his top advisers also knew that there wasn't evidence to support the claims that the president was making," Lofgren said.

"There was never, there was never an indication of interest in what the actual facts were," William Barr said in his recorded testimony. "And my opinion then and my opinion now is that the election was not stolen by fraud."

Clark’s letter and his Oval Office meeting set off one of the tensest chapters during Trump’s effort to overturn the election, which culminated three days later with rioters storming the U.S. Capitol. His plan could have decapitated the Justice Department leadership and could have overturned the election.

Clark’s actions have been the focus of a Senate Judiciary Committee investigation and an ongoing probe by the Justice Department’s inspector general, and now are expected to be closely examined during June hearings by the House committee investigating the insurrection of Jan. 6, 2021.

Clark then met with Trump in the Oval Office, according to the Senate report. In response to the second public hearing of the January 6 committee, former President Donald Trump released a 12-page statement – yes, 12 full pages! – seeking to rebut the charges leveled against him.

It’s filled with the usual name-calling, exaggerations and conspiracy theories that have dominated Trump’s post-2020 election life. But it’s also a window into the former President’s psyche as the January 6 committee weighs whether to recommend a criminal indictment of Trump to the Department of Justice.

1. “If they had any real evidence, they’d hold real hearings with equal representation.”

Remember that the reason there isn’t an independent commission – like the one that investigated the 9/11 terrorist attacks – is because Senate Republican Leader Mitch McConnell killed it after it had passed the House with 35 GOP votes. And away we go!

2. “They use the illegally-constituted committee to put on a smoke and mirrors show for the American people, in a pitiful last-ditch effort to deceive the American public … again.”

It’s not at all clear to me what Trump thinks is illegal about the January 6 committee. It is a select committee established by Speaker Nancy Pelosi. Not unlike the Benghazi select committee established by then-House Speaker John Boehner.

3. “They have refused to allow their political opponents to participate in this process, and have excluded all exculpatory witnesses, and anyone who so easily points out the flaws in their story.”

Again, this is not quite accurate. First off, the reason the committee has two Republicans and nine Democrats is because a) McConnell nixed the idea of an independent commission and b) House Minority Leader Kevin McCarthy pulled all five of his picks for the committee when Pelosi rejected the appointments of Indiana Rep. Jim Banks and Ohio Rep. Jim Jordan. Second, plenty of strongly pro-Trump witnesses have been subpoenaed by the committee. In fact, Steve Bannon and Peter Navarro, two close Trump confidants, have refused to comply with subpoenas to testify before the committee.

4. “The Unselect Pseudo-Committee has coordinated with their media puppets to broadcast their witnesses on national television without any opposition, cross-examination, or rebuttal evidence.”

I hate to sound like a broken record here, but the committee took more than 1,000 depositions from all sorts of witnesses – including Bill Stepien, who managed Trump’s 2020 campaign, and Bill Barr, who served as Trump’s attorney general. Those aren’t exactly portraits of Trump haters. Plus, the committee tried to talk to people like Bannon and Navarro.


5. “What are the members of this treasonous ‘Committee’ afraid of?”

This is coming from someone who refused to accept the results of a free and fair election and incited people to protest the results because of a series of easily debunked conspiracy theories.

6. “Democrats created the narrative of January 6th to detract from the much larger and more important truth that the 2020 Election was Rigged and Stolen.”

Uh, what. So, several people died as a result of the riots on January 6. More than 100 police officers were injured. Over 800 people have been criminally charged for their roles in the insurrection that day. That’s less important that a set of lies about supposed election fraud?

7. “They illegally inflated voter rolls, illegally allowed harvested and stuffed ballots, abused the use of mail-in ballots, physically removed Republicans from counting facilities, abused the elderly in nursing homes, bribed election officials with donations, stopped counting on Election Night, gave Democrats three extra days to harvest ballots, and demanded that the American people believe it was legitimate.”

Wow. That’s, um a lot. There has been absolutely no evidence that there was widespread voter fraud in the 2020 election.

8. “The truth is that Americans showed up in Washington, D.C. in massive numbers (but seldom revealed by the press), on January 6th, 2021, to hold their elected officials accountable for the obvious signs of criminal activity throughout the Election.”

Crowd size has long been a Trump hobbyhorse. But there’s just no evidence that the press purposely low-balled the crowd on January 6. Also, that is totally beside the point. Which is this: A mob of rioters stormed the US Capitol fueled by an election lie pushed by Trump that he had somehow been cheated out of victory.

9. “This is all a ridiculous and treasonous attempt to cover up the fact that Democrats rigged the Election and are siphoning Americans’ freedoms and power for their own benefit.”

What, exactly, is treasonous about the January 6 committee? Trump – surprise, surprise – doesn’t explain.

10. “On Election Night, America watched as my lead grew and grew over Joe Biden, as I was set to claim another victory.”

Simply not true. We knew well in advance of Election Day that, in large part because of new rules in place to deal with the Covid-19 pandemic, the number of mail-in ballots would be far higher than in past elections. And we knew that it would take some time to properly process all of them. Here’s what Stepien, Trump’s campaign manager, suggested he say on election night: “My recommendation was to say that ‘votes were still being counted, it’s too early to tell, too early to call the race but we’re proud of the race we ran and we think we’re in good position.’” Trump didn’t take that advice.

11. “The Swamp was so determined to keep their stranglehold on power that they delayed the results of the Election so that they could find, manufacture, or produce more ballots, after they knew how many they needed to beat me.”

“To date, we have not seen fraud on a scale that could have effected a different outcome in the election,” Barr said on December 1, 2020.

12. “There’s no reasonable explanation for why it took so much longer to count the few remaining ballots as opposed to the millions on Election Day – other than they needed to traffic more ballots, and it took four days to produce the ballots and do it.”

Aside from simply claiming it to be so, Trump offers no evidence for his claim that there were “few remaining ballots” left to be counted after Election Day. The reason he doesn’t offer any proof for this claim is that none exists.

13. “Like drug mules, in this context, mules are those paid to illegally traffic ballots from nonprofits organizations and drop them into the ballot drop boxes.”

It’s well worth watching – or reading – Barr’s complete takedown from Monday’s hearing of the film “2,000 Mules” which is where Trump gets this bogus information. Here’s the gist of it in one Barr quote: “If you take 2 million cell phones and figure out where they are physically in a big city like Atlanta or wherever, just by definition, you will find many hundreds of them have passed by and spent time in the vicinity of these boxes.”

14. “The truth is, according to Joe Biden, that the Swamp has created the ‘most extensive and inclusive voter fraud organization in the history of American politics – and it centers around ballot trafficking.’”

As Reuters noted of the Biden quote cited by Trump here: “It was a slip of the tongue - Biden was describing the voter protection program his campaign has launched in anticipation of potential legal fights over the outcome of the Nov. 3 election against President Donald Trump.”

15. “It’s also highly likely that True the Vote did not uncover 100% of the mules, making the numbers much larger than a landslide in scope, and that there were many more mules out there affecting more of the Election than we realize. This was not a close Election.”

Joe Biden won more than 81 million votes to Trump’s 74 million. So no, by recent measures it wasn’t a particularly close election. But I don’t think that’s what Trump means.

16. “Joe Biden, a candidate who never left his basement and can’t speak without a teleprompter, outperformed Barack Obama and Hillary Clinton in their two high-charged elections.”

In terms of raw vote totals, that’s true. Biden’s 81 million votes is more than either Clinton or Obama received. But, in both 2008 (365) and 2012 (332), Obama received more electoral votes than Biden.

17. “Either there’s a lot of black voters in America who identify more with Joe Biden than Barack Obama, or Democrats are stealing black votes – and we all know the answer to that.”

Before this line, Trump cites a handful of majority-Black counties and areas where Biden did better in 2020 than Obama did in 2008 or 2012. That fact is proof positive of fraud, according to Trump. Of course, it’s not. First of all, the population, in the Black community and elsewhere, grew between 2008 and 2020, meaning that there were just more voters to be had for Biden than for Obama. Also, and I am just spitballing here, isn’t it possible that the desire to vote Trump out of office was a powerful motivator for lots and lots of Black voters?

18. “Mark Zuckerberg contributed $419 million dollars to election initiatives around the country.”

Trump is suggesting here that Zuckerberg, the founder of Facebook, spent hundreds of millions of dollars to ensure that Democrats won the 2020 election. The only thing he gets right though is the amount of money Zuckerberg spent. Trump would do well to read this Protocol piece headlined “How ‘Zuck Bucks’ saved the 2020 election — and fueled the Big Lie.”

19. “Zuckerberg should be criminally prosecuted. Election laws prevent individuals from donating more than $5,000 per year, yet Zuckerberg gave $419 million.”

Again, Trump is simply wrong about what Zuckerberg did in the 2020 election. As Protocol notes: “He offered grants to any election official who wanted one, so long as they spent it on what a lot of people would consider mundane essentials that make it easier and safer for everyone to vote: ballot sorters, drop boxes, poll workers and — because it was 2020 — hand sanitizer.”

18. “Rumors circulated that the Justices devolved to shouting and argued intensely over how to handle the Texas v. Pennsylvania case. Ultimately, the Justices yielded to the same fear mongering tactics Democrats had deployed for years. They punted and threw the case out on standing.”

As CNN reported of the election fraud case brought by Texas Attorney General Ken Paxton: “The court’s order, issued with no public dissents, to dismiss the challenge is the strongest indication yet that Trump has no chance of overturning election results in court, and that even the justices whom he placed there have no interest in allowing his desperate legal bids to continue.” No public dissents. So, yeah.

19. “But, the Swamp runs deep. I guess that turning around an election was a step too far.”

Yes, I would say overturning an election was a “step too far.”

20. “Americans are struggling to fill their gas tanks, feed their babies, educate their children, hire employees, order supplies, protect our border from invasion, and a host of other tragedies that are 100% caused by Democrats who obtained power through a rigged election, and the people of our country are both angry and sad.”

This sentence is 53 words long. Yup.

21. “Nobody brings this up, but as President, I suffered years of vicious lies, scandals, and innuendo concerning a fake and contrived narrative of Russia, Russia, Russia.”

Allow me to quote from the Mueller Report: “(I)f we had confidence after a thorough investigation of the facts that the President clearly did not commit obstruction of justice, we would so state,” reads the Mueller report. “Based on the facts and the applicable legal standards, we are unable to reach that judgment. … Accordingly, while this report does not conclude that the president committed a crime, it also does not exonerate him.”

"You just described this plan as a way to take an election where the outcome was established" and "legal remedies had been exhausted" all the way to the Supreme Court, Melber recapped. "Then you will use the incumbent losing party's power — that was the Republican Party that was losing power — to overtake and reverse that outcome. Do you realize you are describing a coup?" Navarro didn't accept the premise, arguing, for instance, that the elected secretaries of state in Michigan and Pennsylvania "were put in power by George Soros." 
"Your presumption is the remedies were exhausted; my presumption is the remedies weren't exhausted at all," Navarro said. "The remedy was for Vice President Pence, as the quarterback in the Green Bay Sweep, to remand those votes back to the six battleground states." Justice Is Blind. And So Is Merrick Garland
The DOJ's long fall from grace.



Punch for punch, the debasement of Attorney General Merrick Garland is without historical correlate. The self-defeating adherence to ideological centrism (often indistinguishable from passivity in the face of elite resistance), paired with his masochistic devotion to the status quo, represents the kind of Blue Dog/New Dem totem that could have only emerged from a lab. Corporatist Democrats believed during the Obama years, as they do now, that through the ritual sacrifice of their Democratic ideals, they could resurrect the corpse of a forgotten age when left and right joined hands to strangle the everyday citizen. That union never happened after the GOP realized they could simply steamroll Democrats like Garland who refuse to open their eyes to the Conservative onslaught, even when it was punching them in the face.

If Garland's stain on DOJ wasn't bad enough, Biden's failure to man the DOJ's barracks with U.S. attorneys has further deflated the already anemic law enforcement agency.
The consolation prize Garland received after a thorough curb stomping by Mitch McConnell on the steps of the Supreme Court is his chair in the DOJ's highest office. Perched above the statue of lady justice, Garland seems to have taken inspiration from her shrouded visage and affixed his own blindfold to blot out the clown car of cartoon villains unloading into congressional hearings to stand trial for their respective roles in the attempted insurrection.

Tens of millions of Americans will tune in to the ongoing January 6 hearings in an attempt to reconcile the desecration of their Capitol with America's wilted top cop Garland cowering in the corner. In the shadow of the hulking figure Bill Barr once cut, a shaken tit mouse has taken up residence, beset on all sides by crumbling institutions and sinister schemes: Donald Trump plotting a comeback, unchecked Wall Street profiteers, and a host of corporate criminal enterprises seizing on a cowed Attorney General.

Similarly pathetic is the talk of secret progress being made to hold accountable the orchestrators of the attempted coup; a story identical to the prosecutions of Wall Street fraudsters under Obama. With the statute of limitations already passing on multiple Trump crimes and some Trump lackeys being allowed to evade Congressional subpoenas, better to call out the likelihood of failure when pressure can still alter its course than to wait for certainty of failure. This is especially the case since both the height of the midterm elections and Trump's likely entrance into the presidential race immediately thereafter will only exacerbate the downsides of Garland's plodding course thus far.

If Garland's stain on DOJ wasn't bad enough, Biden's failure to man the DOJ's barracks with U.S. attorneys has further deflated the already anemic law enforcement agency. As RDP's Toni Rosenthal wrote this week, "This month President Biden nominated five additional people to helm the 93 districts of the Office of the United States Attorney. These five nominees brought Biden's total nominations for the office up to just 53 out of 92 nominees for the office, or a little more than half. Now, nearly a year and a half into Biden's presidency, the fact that almost half of these positions are still left without a nominee is a glaring indictment of Biden's failure to prioritize these critically important positions."

For the few and far between enforces who have spine enough to pursue the giant corporations robbing Americans blind, Garland has effectively neutered them, at least for the time being. As Andrea Beaty, my colleague here at the Revolving Door Project (RDP), wrote this week:

The Department of Justice's recent decision to bar Assistant Attorney General for Antitrust, Jonathan Kanter, from working on investigations into tech giant Google while the Department weighs whether to force his recusal outright reflects an undeniable double standard in light of the widespread conflicts of interest at the DOJ. Kanter's mistreatment further demonstrates the Justice Department's overwhelming commitment to protecting the interests of big business.

Kanter's critics within the DOJ charge that his previous work in the private sector presents a conflict of interest when it comes to cases involving Google. In doing so, they and their allies in Silicon Valley not only mischaracterize the nature of Mr. Kanter's work, but are also establishing an 'ethical' precedent that many current DOJ officials do not come close to meeting.

Governance

The DOJ is not the only oversight agency wielding vast powers to crack down on bad actors that continues to flail under the Biden administration. The Food and Drug Administration has deflated under a decades-long decline, culminating in the fatal, tragic, and politically disastrous baby formula shortage that has wreaked havoc across the country.

As RDP's Toni Aguilar Rosenthal and Mekedas Belayneh wrote this week, "Government negligence has resulted in a hollowed-out FDA failing to prevent the deadly food outbreaks that kill 3,000 people a year. To put this number in perspective, the FDA's failure to protect the food we eat kills the same number of people as died in 9/11, every single year. The public deserves better. People across the country should be able to go to the grocery store and buy food that they know is safe, not that they simply hope to be. FSMA provided a blueprint for greater food safety enforcement and oversight at the FDA, but the underfunded, disorganized, apathetic agency never fulfilled the goals of the legislation. Will it take another crisis for the government to take its approach to food safety seriously?"

Meanwhile, the very titans of digital industry that an invigorated DOJ should be cracking down on are buoyed and supported by none other than Commerce Secretary Gina Raimondo as she seeks to position herself for a new job as Treasury Secretary. Instead of advocating for American workers and the companies that pay living wages to produce American products, Raimondo has used her position to advocate for the very tech companies that have weaponized social media platforms into political instruments and destabilized entire countries. Writing in The American Prospect on Tuesday, RDP's Mekedas Belayneh noted:

"The Department of Commerce is currently conducting digital trade talks with nations from the Indo-Pacific and Europe, with negotiations led by its secretary, Gina Raimondo. Through her role as lead negotiator in President Biden's newly established Indo-Pacific Economic Framework (IPEF) and one-year-old U.S.-EU Trade and Technology Council (TTC), Raimondo is poised to influence global trade policies.

Last December, Sen. Elizabeth Warren (D-MA) attacked Secretary Raimondo for "lobbying on behalf of Big Tech companies overseas," and it's easy to see why. Deemed "tech's favorite Biden official," by Axios for defending American tech companies from European regulators, Raimondo's sympathy with Big Tech's agenda has become even more obvious in these high-stakes negotiations."

With so much stake and time running out, the administration's failures at the DOJ, the FDA, and the Commerce Department can no longer be tolerated. It's time for Merrick Garland to see the light, before November's darkness swallows us whole.

Former aides to Donald Trump and Mike Pence made it clear they did not agree with attorney John Eastman’s assertion that former Vice President Mike Pence had the power to unilaterally declare Trump had won the 2020 presidential election.
The panel played a video montage of earlier testimony from Trump and Pence advisers who either said they believed there was no basis to Eastman’s theory or said others in the administration vehemently disagreed with the lawyer.

Herschmann said Eastman tried to explain to him what he believed was ambiguity in the laws. 
Herschmann said he told Eastman: “You're saying that you believe the vice president, acting as president of the Senate, can be the sole decision maker as to, under your theory, who becomes the next president United States?”
“And he said yes,” Herschmann continued. “I said, ‘Are you out of your effing mind?’
“I said, ‘You're completely crazy.’ I said, ‘You're going to turn around and tell 78-plus million people in this country that your theory is this is how you're going to invalidate their votes because you think the election was stolen.’ I said, ‘They're not going to tolerate that. You're going to cause riots in the streets.’
“And he said words to the effect of, there's been violence in the history of our country to protect the democracy or to protect the republic,” Herschmann added.
Marc Short, who served as Pence’s chief of staff, said it was communicated to him that White House counsel Pat Cipollone believed Eastman’s interpretation was “nutty.”
Jason Miller, a senior adviser to Trump’s reelection campaign, said fellow campaign officials Justin Clark and Matt Morgan thought Eastman’s “theory was crazy, that there was no validity to in any way, shape or form.”

On CNN this morning, Representative Jamie Raskin (D-MD), a member of the House Select Committee to Investigate the January 6th Attack on the U.S. Capitol, said: “New evidence is breaking every single day now. Suddenly, a lot of people want to tell the truth.”

After the committee’s third public hearing today, we can see why. The window for getting onto the good side of the investigation by cooperating with it is closing, and the story the congress members are laying out makes it clear that those sticking with Trump are quite likely in legal trouble.

It appears that the former president thinks the same thing. Before today’s hearing, he wrote: “I DEMAND EQUAL TIME!!!”

But it seems unlikely Trump wants to tell his version of what happened around January 6 under oath, and if he were misled by his advisors, who can doubt that he would already have thrown them under the bus?

And, so far, the committee has used testimony and evidence only from those high up in Trump’s own administration. Today was no exception. The committee covered the former president’s pressure campaign against his vice president, Mike Pence, to overturn the results of the 2020 election. Instead of following the law, codified in the 1887 Electoral Count Act, Trump wanted Pence to use his role as the person charged with opening electoral votes to throw out the votes that gave Democrat Joe Biden victory, or at least to recess the joint session of Congress for ten days to send the electoral slates back to the states, where pro-Trump legislatures could throw out the decision of the voters and resubmit slates for Trump.

In interviews with Pence’s former counsel Greg Jacob, as well as retired federal judge J. Michael Luttig, formerly of the U.S. Court of Appeals for the Fourth Circuit, the committee established that this plan, advanced by lawyer John Eastman, was illegal. Indeed, Eastman himself called it illegal, first at length in October 2020, and then in both written and verbal admissions after the election. And the committee established that Eastman, as well as others, told Trump the plan was illegal.

The hearings today hammered home that the centerpiece of our government is that the people have the right to choose their leaders. That concept is central to the rule of law. And yet, Trump embraced an illegal and unconstitutional theory that, instead, the vice president—one man—could overrule the will of the people and choose the president himself. Such a theory is utterly contrary to everything the Framers of the Constitution stood for and wrote into our fundamental law.

And yet, by early December 2020, after their legal challenges to the election had all failed, Trump’s people began to say that Pence could throw out the electoral slates that states had certified for Biden, or could send those certified electoral slates back to the states for reconsideration so that Republican-dominated legislatures could then submit new slates for Trump. Judge Luttig hammered home that there is nothing in either legal precedent or historical precedent that gave any validation to the idea that one man could determine the outcome of the election.

Still, on December 13, the day before the Electoral College met, lawyer Kenneth Chesebro wrote to Trump lawyer Rudy Giuliani arguing that Pence could refuse to count the votes from states that had “alternative” electors (we also know that he wrote about this idea for the first time on November 18, so that might have been the chatter Pence was hearing). At the time, the scheme to create second slates of electors was underway.

Eastman then took up the cause, saying that seven states had submitted “dual” slates of electors. When Jacob dismissed that claim, Eastman just said that Pence could just call them disputed anyway and throw the votes from those states out. Luttig reiterated that these fake electors had no legal authority whatsoever and that there is no historical or legal precedent at all to support the idea that the vice president could count alternative electoral slates to the ones certified by the states.

Both Pence’s counsel Jacobs and his chief of staff Marc Short believed that Eastman’s plan was bananas, and an avalanche of White House advisors agreed. According to today’s testimony, those agreeing included Trump’s chief of staff Mark Meadows, White House counsel Pat Cipollone, Trump lawyer Eric Herschmann, and Trump advisor Jason Miller, who testified that people thought “Eastman was crazy.” Herschmann testified that even Trump lawyer Rudy Giuliani agreed on the morning of January 6 that Eastman’s argument wouldn’t stand up in court.

Nonetheless, Giuliani went out in front of the crowd at the Ellipse on January 6, insisted that the theory was correct, and lied that even Thomas Jefferson himself had used it.

Meanwhile, beginning in December, Trump had been pressuring Pence to go along with the scheme. Pence had refused, but Trump kept piling on the pressure. At rallies in early January, he kept hammering on the idea that Pence could deliver the election to Trump, and in meetings on January 4 and 5, he kept demanding that Pence overturn the election. When Pence continued to refuse, Trump appeared to try to lock him in by tweeting on January 5 that he and Pence were “in total agreement” that Pence could act to change the outcome of the election.

By then, Short was so worried about what Trump might do on January 6 that he told the Secret Service he was concerned about Pence’s safety.

On January 6, Trump called Pence on the phone and, according to witnesses, called him a “wimp” and a “p*ssy.” Pence then issued a statement saying it was his “considered judgment that my oath to support and defend the Constitution constrains me from claiming unilateral authority to determine which electoral votes should be counted and which should not.” Trump then went before the crowd at the Ellipse and added to his prepared speech sections attacking Pence.

After Trump’s chief of staff Mark Meadows told him that violence had broken out at the Capitol, Trump tweeted that “Mike Pence didn’t have the courage to do what needed to be done,” and violence ratcheted up. The committee showed rioters claiming they were there because Pence had let them down. “Pence betrayed us…the president mentioned it like 5 times when he talked,” one said. That 2:24 tweet was “pouring gasoline on the fire,” one White House press member told the committee. At 2:26, Pence and his family were evacuated to a secure location, where he would stay for more than four hours. The rioters missed the vice president by about 40 feet. A Proud Boy told the committee that if they had found Pence, they would have killed him.

Even after the crisis ended, Eastman continued to write to Pence’s people asking him to send the electoral slates back to the states. Herschmann advised him to “get a great effing criminal defense lawyer. You’re going to need it.” Eastman then put in writing that he wanted a presidential pardon: “I’ve decided I should be on the pardon list,” he wrote. When he did not get a pardon, he took the Fifth Amendment before the committee, asserting his right against self-incrimination more than 100 times.

There were lots of places where Pence and his team were no heroes. They could have warned any number of people about what Trump was up to long before January 6, and Pence’s apparently noble stance was undoubtedly informed by a realization that if Pence did as Trump asked and it went wrong—even Eastman acknowledged the scheme was illegal—Pence would be the one holding the bag.

But the committee left all that unsaid. Instead, it went out of its way to make a very clear distinction between Trump, who was out for himself and damn the country, and Pence, who risked his own safety to follow the law. Indeed, that theme was so clear it appeared to have been carefully scripted. Today’s testimony highlighted the principles of Jacob and Short and their boss, Mike Pence. It even took a deliberate detour to let both Jacob and Short talk about how their Christian faith helped them to stand against Trump and do what was right, an aside that seemed designed to appeal to the evangelicals supporting Trump. And it highlighted how Pence continued to do the work of governing even while he was in the secure location, which looked much like a loading dock according to new photos shown today.

The committee seems to be presenting a clear choice to Republicans: stand with Trump, a man without honor who is quite possibly looking at criminal indictments and who is trying to destroy our democracy, or stand with Pence, who embraces the same economic and social ideology that Republicans claim to, without wanting to destroy our democracy.

The appearance of Judge Luttig today was in keeping with this theme. Luttig is such a giant in conservative legal circles that he was talked of for the Supreme Court in place of Samuel Alito, and his words bear extraordinary weight. Luttig hammered home that Trump’s scheme was an attempt to overturn the rule of law and to destroy our democracy. And, he warned, the danger is not over. Trump and his supporters remain “a clear and present danger to American democracy.”

Luttig’s testimony was powerful, but even more extraordinary was a statement he released before today’s hearing. Luttig, for whom both Eastman and Senator Ted Cruz (R-TX) clerked, warned that “January 6 was…a war for America’s democracy, a war irresponsibly instigated and prosecuted by the former president, his political party allies, and his supporters.”

That is, Luttig laid the responsibility for today’s national crisis at the door of the Trump wing of the Republican Party. He went on to warn that only it could reject the attempt of the president and his supporters to undermine the faith in our elections that underpins our democracy: “[O]nly the party that instigated this war over our democracy can bring an end to that war…. These senseless wars…were conceived and instigated from our Nation’s Capital by our own political leaders…and they have been cynically prosecuted by them to fever pitch, now to the point that they have recklessly put America herself at stake.”

Luttig urged Americans to remember that the fate of our democracy is in our hands and to reject the fever dreams of the Trump Republicans in favor of “a new vision, new truths, new values, new principles, new beliefs, new hopes and dreams that hopefully could once again bind our divided nation together into the more perfect union that ‘We the People’ originally ordained and established it to be.”

“The time has come,” Luttig wrote, “for us to decide whether we allow this war over our democracy to be prosecuted to its catastrophic end or whether we ourselves demand the immediate suspension of this war and insist on peace instead. We must make this decision because our political leaders are unwilling and unable, even as they recklessly prosecute this war in our name.”

A culture of intimidation pervaded the Department of Justice in 2020.
Trump had spent four years blurring the lines between the executive branch and the judicial branch, but never was it as murky as it became after he lost the election. 
At the center of this muck was Jeffrey Clark, an environmental lawyer introduced to Trump by Rep. Scott Perry, a Pennsylvania Republican long sympathetic to Trump’s election fraud conspiracy theories.
Clark was appointed to the Department of Justice by Trump just like Rosen, Donoghue, and Engel. But once inside, Clark kept an alliance with the president and engaged in what Thursday’s witnesses have previously described to the Senate Judiciary Committee as a campaign to oust officials who dared go against Trump.
According to records and interviews, it was Jan. 3, 2021 when Clark met with Trump in the Oval Office and presented the president with a letter.
It was a draft intended to go to the leaders of various legislatures in states that Trump had lost, like Georgia. Clark had shown this letter to Rosen days before the meeting in the Oval with Trump. Rosen rejected it wholesale, telling Clark the fraud claims were unsubstantiated and he could not back it.
The men had already met the month before and Rosen made his positions clear: The claims were dubious. But at that December meeting, Rosen had also learned that Clark had sessions with Trump in secret, something forbidden by department protocol. Rosen ordered Clark not to do it again. Clark disobeyed him.
A day before the Jan. 3 meeting in the Oval Office, Clark asked to meet with Rosen in private. Rosen agreed, but he didn’t want to go alone. He asked Donoghue to join them. 
It was there that Clark—their subordinate—informed them that Trump wanted to replace Rosen. And Clark would be the one to do it. 
He wanted that letter out.

Right! No one's contesting the meat of her testimony, the damning part.

There were some preliminary plans for the 1/6 Committee to hold a hearing on Thursday this week in addition to their hearing tomorrow, but I'm told those plans have been shelved.
That hearing, expected to focus on the 187 minutes of the Capitol siege and what member's call Trump's dereliction of duty will still happen. The committee just needs time to get the hearing planned. Apparently Pat Cipollone testimony was very forthcoming.

A logical conclusion for this committee is to investigated what happened on January 6th all the way to the Supreme Court, since SCOTUS are about to judicate on democracy with identical strategy used by the orchestrators of the January 6th coup d'etat by negating votes, to negate entire election.

They brought an executive order that had been drafted on December 15, the day after the electors had certified the votes for Biden. It called for Trump to order the Defense Department to seize state voting machines, and it appointed Powell as special counsel to investigate voter fraud, giving her broad powers. Supporters wrote comments like: “Why don’t we just kill them? Every last democrat, down to the last man, woman, and child?” and, making the link between Trump’s determination to stay in office and white supremacy: “It’s time for the DAY OF THE ROPE! WHITE REVOLUTION IS THE ONLY SOLUTION!”

As Trump continued to post about January 6 on Twitter and continued to insist he had won the election, militias, white supremacists, and conspiracy theorists began to work together to coordinate an attack on the Capitol. He then filed a lawsuit objecting to the probe.

According to the Office of Inspector General Department of Homeland Security (OIG), the U.S. Secret Service (USSS) erased “text messages, from January 5 and 6, 2021.” The letter originally sent to the House and Senate Homeland Security Committees by the Department of Homeland Security Inspector General states that the messages were erased during what the USSS called  “a device-replacement program.”

Whether or not this is above board becomes even more questionable, according to OIG’s letter, when you consider that those erased text messages were “after OIG requested records of electronic communications from the USSS, as part of our evaluation of events at the Capitol on January 6.” On top of this, the letter reports that OIG inspectors have been stonewalled in their requests for “records of electronic communications” by the USSS.

CNN - A Washington, DC, police officer has corroborated to the House select committee investigating January 6, 2021, details regarding a heated exchange former President Donald Trump had with his Secret Service detail when he was told he could not go to the US Capitol after his rally, a source familiar with the matter tells CNN.

The officer with the Metropolitan Police Department was in the motorcade with the Secret Service for Trump on January 6 and recounted what was seen to committee investigators, according to the source.

"Trump was so enraged at his Secret Service detail for blocking him from going to the Capitol on the day of the insurrection that “he reached up towards the front of the vehicle to grab at the steering wheel” and “then used his free hand to lunge towards” his Secret Service lead agent Robert Engel."

James Mault was fired from his union job after the insurrection, but was able to re-enlist in the U.S. Army even though he had been interviewed by the FBI about his actions on Jan. 6. At the time of the initial FBI interview, the bureau was apparently unaware that he assaulted officers that day.

“They were not patriots on Jan. 6,” Howell said. “No one who broke police lines that day were. They were criminals.”

This was the occasion of his daughter’s electoral defeat at the hands of another Republican, Harriet Hageman. Neoconservative bumbler and part of an enterprise that loves war and cherishes the buccaneering free market, Liz Cheney was facing final judgment at the hands of voters in Wyoming for her belligerent position against Donald Trump.

Cheney had hoped to purge the GOP of Trumpist influence by simply reiterating her own toxic alternative, the very sort that did much to bring about the success of Trump in the first place. All that mattered was reiterating her hatred of orange-haired ogre and his alleged role in the January 6, 2021 Capitol riot.

This was a bit much given how she had done little by way of condemning Trump for any earlier misdeeds even as the GOP was being transformed. As a matter of fact, her voting record for Trump’s proposals comes in at an astonishing, distinctly non-dissenting 93%.

Former Republican Rep. Justin Amash issued a strong rebuke last year regarding her newly fashioned image in the party. She could hardly be seen as “some sort of hero”, having come to the anti-Trump show belatedly late. She might have joined him in his earlier warnings that “the president’s approach could lead to things like violence, could lead to a lot of animosity and contempt and all sorts of things that would be harmful to our country.”

During her time in Congress, Cheney also showed hostility to raising the minimum wage, voted against the Equality Act and the Equal Rights Amendment, the Voting Rights Act, the George Floyd Act and the Build Back Better and Infrastructure bills. And that’s just a modest sampling.

Cheney’s position as vice chair on the January 6 committee was purely decorative. For all his Caesar-like pretensions, he was not an adventurist in the way President George W. Bush was, nor committedly Machiavellian in the manner of Dick Cheney. Besides stealing the 2000 election, a point virtually no one sober enough after the fact amongst Democrats and Republican strategists can deny, Bush went on to destabilise and crater the Middle East and give a very complete account about how dismal the neoconservative cabal could be.

In due course, the neocons, with the Cheney mindset running the show, converted the US government into a forward base for forced democratisation even as they were destroying democracy – or an impression of it – at home. (A plantation, property-minded republic with a constitution to match was never intended as a democracy.) It made Dick Cheney’s plea for his daughter’s re-election darkly laughable. “In our nation’s 246-year history,” went the campaign ad fronted by Father Dick, “there has never been an individual who is a greater threat to our republic than Donald Trump.”

Daughter Liz is hoping for bigger, more ruinous things. In her graceless non-concession speech, she promised that “our work is far from over”. This project, she suggested, lay in the battle against “the conspiracy and the lies” regarding the 2020 elections. She promised to “do whatever it takes” to deny any pathway for Trump’s return to the White House.

This immediately had commentators jotting down options. Did that mean that Cheney would have a stab at the office herself? (She subsequently revealed on NBC’s Today that she was toying with the idea.) Any primary run against Trump would seem positively quixotic, though she did allude, irrelevantly, to one of the Republic’s most remarkable and devious minds as a source of inspiration. “Abraham Lincoln was defeated in elections for the Senate and the House before he won the most important election of all.”

Nothing proved sacred to Cheney, who also mentioned Lincoln’s Gettysburg address, “That we here highly resolve that these dead shall not have died in vain. That this nation under God shall have a new birth of freedom and a government of the people, by the people and for the people shall not perish from the earth.” Pity those last words seemed to have been ignored by her family.

In her dig through Civil War history, not even Ulysses S. Grant was spared. The Union General, instead of heading back to the safety of Washington, decided to head to Richmond “and the heart of Lee’s army. Refusing to retreat, he pressed on to victory.”

Bringing the spirits of Lincoln and Grant into play, along with the nonsense of the US being “the best hope of freedom on earth”, was in spectacularly poor taste. The Cheney family has made a truly corking effort in shredding the Republic Lincoln tried saving. Along the way, they managed to lose a constituency. There was never much in the way of principle here – except the one that only ever matters for the Cheneys: power, and how to possess it.

That was the now disgraced William Barr's memo not the actuall Mueller russian interference report. M'kay.

Leaders of the far-right militia groups Oath Keepers and Proud Boys have been charged with this crime. Seditious conspiracy is a rare and serious charge, alleging they forcefully tried to overthrow the peaceful transfer of presidential power. A handful of attackers have pleaded guilty to it.

Trump committed fraud by fundraising on the false basis that the election was stolen.
